Hope those of you who participated in the annual garage sale had great success!
 
Please see the following updates on our legal case and other activities.
 
Legal (Case # 2021-0208)
 
When we considered filing this case, board members interviewed multiple law firms in the Tulsa area. Our concerns included counterclaims, expenses, and legal grounds for our claim. Our investigation satisfied our concerns supporting our decision to file as an HOA and add our names as plaintiffs to the case.

Several folks recently battled or are currently battling Covid - we hope that you and yours are healthy and well! Friendly reminder that our upcoming neighborhood garage sale is September 10th.

I hope everyone has enjoyed the summer, and found activities to keep cool! With the annual garage sale coming up on September 10th, now is an opportune time to start cleaning out your closets.
 
 
FACT: the attorneys for the defense filed a motion to extend dates by 30 days, claiming they needed more time to prepare.
FACT: the following parties were added to the lawsuit as defendants, given that they own a portion of the golf course: Bixby Land Investment Group, LLC and White Hawk Golf Club, LLC.
FACT: property values continue to rise.
FACT: the golf industry is having its 3rd strong year, with an infusion of new golfers - women and millennials.
FACT: the lawsuit is to obtain a declaratory judgment that our deed of dedication is intact.
FACT: there is a 15' drainage easement behind properties backing up to the golf course, which restricts anyone from modifying the land or building anything on it (including a fence) without city engineer approval. For reference, see our linked plat and read section 1.3 (we reiterate this due to the number of claims from owners that they have been offered a certain number of feet of property behind their home in exchange for their signature).
FACT: the city of Bixby asked Kevin Jordan if he would sell Celebrity Country Reserve "A" (the golf course property) to them. He said no, which is why no offer materialized (we reiterate this due to claims from the Black Gold Group that they have received no offers).

I hope those who participated in the neighborhood garage sale were successful! Thankfully, we had a sunny day for it.
 
Hoping to clear up some misdirection...
 
Legal:
 
FACT: the city of Bixby asked Kevin Jordan if he would sell Celebrity Country Reserve "A" (the golf course property) to them. He said no, which is why no offer materialized.

FACT: our property values have increased.

  • Kevin Jordan is the CEO of the Black Gold Group and owner/manager/registered agent of many others. Note: Kevin Jordan's companies involved in the golf course are: White Hawk Investments (Development Area A), Bixby Land Investments (Development Area B), and Venue Ventures (Development Area C).
  • Jared Cottle is the City Manager of Bixby.
  • J R Donelson is the Chair of the Bixby Planning Commission and Vice Chair of the Board of Adjustment.
 
The attached documents demonstrate a direct business relationship between City Manager Jared Cottle and Kevin Jordan. Windrush II on Mingo is a multi-family residential development near 131st and Mingo. The survey was done by J R Donelson (Bixby Planning Commission Chair).

Legal:
 
UPDATE: Judge Caroline Wall canceled the 4/11 scheduling hearing since the attorneys agreed to a court schedule. The pre-trial date is 1/18/23. However, there are significant deadlines this year from August through November.
NOTICE: We have received inquiries as to whether an owner who signed the developer's amendment to remove the restrictions on our Reserve A can reverse their decision. Yes. Our understanding is that owners must send a formal communication to Kevin Jordan and a copy to the HOA.
FACT: Any developer that acquires Celebrity Country's Reserve A is bound by the existing zoning and PUD unless changes are submitted and approved by the city of Bixby, and the restrictive covenants that only owners can change.

Hello neighbors!
 
We hope everyone had an enjoyable Spring break and adjusted to the time change. Did you know that there is a nesting pair of bald eagles located near the intersection of Sheridan and 141st? We spotted one of them near the pond by #5/6 last week!
 
Just a few updates this week.
 
Legal:
 
UPDATE: The first meeting of attorneys with the Judge (Caroline Wall) is scheduled for 4/11/22. This is the scheduling meeting for the case. Arguments are not heard at this time.
FACT: Attorneys for the defense have not contacted our attorney.
REMINDER: the developer claimed that our deed is irrelevant. Why press owners for a signature if he is so confident? If our deed of dedication has no value, why are individual offers being made for signatures?

Welcome to the first day of Spring! If you are planning to clean out your closets, now is a great time.  Mark you calendars for our Spring garage sale: April 30th, 8am - 2pm.
 
Legal
 
UPDATE: Court ordered parties to submit agreed upon dates by March 30th for the initial meeting with the judge. If no agreement, the date is set for April 11.
FACT: the form that the developer is encouraging owners to sign only removes the restrictions (and your leverage) on Reserve A (the golf course properties). It does not align building requirements to mesh with the existing neighborhoods (such as fencing or roofing), covenants, or resolve green space open questions.
UPDATE: The City of Bixby provided three permits relating to the golf course properties since last Fall, according to their response to my request for records under the Oklahoma Open Records Act.
  • Sitework: R. McCarty, Select Design (see included emails. Kevin Jordan mistakenly implied that development area C was entirely zoned commercial)
  • Signs: L. Ward, Owner within the neighborhood

We appreciate your ongoing patience. To reiterate our previous statement, we stand united with you all in our concern for the safety and future of our neighborhood. We are long-term residents, love our community, and have no plans to leave.
 
We are concerned there may be some misunderstanding, given recent communications sent to owners.  Here are some facts for you to consider.
 
1. FACT: the parties in the case are
    a. plaintiffs: Brian Cozad, Christie Rooney, and the legal entity CCWHHOA (does not include ANY other owners)
    b. defendants: Venue Ventures LLC and White Hawk Investments LLC
2. FACT: the lawsuit is to validate that our deed of dedication is intact and enforceable.
3. FACT: in order for the Black Gold Group's master planned community to proceed, one of the following must happen:
    a. the developer must win the lawsuit
    b. the developer must convince owners to voluntarily remove the restrictive covenant on the golf course and secure the required votes

Dear Owners,
 
We appreciate and share with you the concern for the safety and future of our neighborhood and our home values. We feel this common belief unites all of us.
 
This letter's purpose is to respond to requests for information by owners regarding the lawsuit.
At the annual meeting on October 24th, the homeowner update on Reserve A (golf course properties) included the topics of code enforcement, interested buyer, and pending sale/development (see slide below).

A lawsuit was filed December 9, 2021 by Brian Cozad, Christie Rooney, and Celebrity Country White Hawk Homeowners Associaion, Inc entity itself to defend the Deed of Dedication. To clarify, CCWHHOA, Inc. is our HOA, not individual homeowners.
