HOA Legal Update

Dear Owners,
 
We appreciate and share with you the concern for the safety and future of our neighborhood and our home values. We feel this common belief unites all of us.
 
This letter's purpose is to respond to requests for information by owners regarding the lawsuit.
At the annual meeting on October 24th, the homeowner update on Reserve A (golf course properties) included the topics of code enforcement, interested buyer, and pending sale/development (see slide below).
 
 
 
We subsequently emailed a link to the presentation to the owners.
Notes:
  • The Black Gold Group provided no prior notification to CCWHHOA concerning the intent to develop the Whitehawk Conference Center and movement to secure site work approval.
  • Before this development, the board's communication regarding Reserve A continued with Mr. Jordan (Black Gold Group).
  • After investigating the development, the board consulted with multiple legal firms regarding the deed of dedication and the current situation resulting in discussions and a decision to move forward with legal action. We retained Doerner, Saunders, Daniel, and Anderson for this purpose.
  • See the following link to review the lawsuit and updates Case CV-2021-2028. Please note that this legal action is for summary judgment regarding the deed of dedication restrictive covenant relevant to Reserve A.
The plaintiffs in the case are Brian Cozad, Christie Rooney, and the legal entity CCWHHOA.
Our HOA does not provide special assessments for legal purposes. Thus, anyone may donate for legal defense.
 
Finally, we believe that an intact deed of dedication has value for all owners.
