President's Message and Update 8/10/22

I hope everyone has enjoyed the summer, and found activities to keep cool! With the annual garage sale coming up on September 10th, now is an opportune time to start cleaning out your closets.
 
 
FACT: the attorneys for the defense filed a motion to extend dates by 30 days, claiming they needed more time to prepare.
FACT: the following parties were added to the lawsuit as defendants, given that they own a portion of the golf course: Bixby Land Investment Group, LLC and White Hawk Golf Club, LLC.
FACT: property values continue to rise.
FACT: the golf industry is having its 3rd strong year, with an infusion of new golfers - women and millennials.
FACT: the lawsuit is to obtain a declaratory judgment that our deed of dedication is intact.
FACT: there is a 15' drainage easement behind properties backing up to the golf course, which restricts anyone from modifying the land or building anything on it (including a fence) without city engineer approval. For reference, see our linked plat and read section 1.3 (we reiterate this due to the number of claims from owners that they have been offered a certain number of feet of property behind their home in exchange for their signature).
FACT: the city of Bixby asked Kevin Jordan if he would sell Celebrity Country Reserve "A" (the golf course property) to them. He said no, which is why no offer materialized (we reiterate this due to claims from the Black Gold Group that they have received no offers).
 
CITY
 
FACT: During the July 25th, 2022 City Council meeting, the city confirmed that Master Comp Plan changes must occur before zoning and PUD changes. This did not occur on Reserve A, the golf course property.
FACT: We presented to the city that they filed Ordinance 2260 in error, since it failed in October and November of 2018 and has not been brought back for consideration. They agree that it should be revoked and rescinded immediately, acknowledging the error. We also provided correspondence from the city planner and city manager from 2019 and 2020 confirming that the ordinance did not pass.
FACT: During the August 8th, 2022 City Council meeting, agenda item 2 was to consider and take action to revoke and rescind Ordinance 2260. They elected to postpone this decision and action to the next meeting as the council was not provided detailed information from staff.
FACT: Kevin Jordan requested the city consider providing a permit to allow him to convert the golf cart barn into a house since the city rejected his plans to build a lodge. Jared Cottle previously advised council that a "replat" would need to occur before any residential housing could be built there. The website for Vinterra describes the golf cart barn as a lodge that will house up to 20 people.
FACT: Kevin Jordan offered to sell the flood plain land to the City of Bixby for one million dollars. This land is the property he offered to "give" to the Master HOA for maintenance.

FACT: Several open records requests remain unanswered from the City of Bixby.
 
Kevin Jordan's current activities at the clubhouse area involve building a wedding and event center with an associated sleeping lodge. The website for the proposed wedding venue is vinterratulsa.com. Note: a lodge is not an approved use and the city attorney communicated this to Kevin Jordan.
