President's Message and Legal Update 04/01/22

Hello neighbors!
We hope everyone had an enjoyable Spring break and adjusted to the time change. Did you know that there is a nesting pair of bald eagles located near the intersection of Sheridan and 141st? We spotted one of them near the pond by #5/6 last week!
Just a few updates this week.
Legal:
UPDATE: The first meeting of attorneys with the Judge (Caroline Wall) is scheduled for 4/11/22. This is the scheduling meeting for the case. Arguments are not heard at this time.
FACT: Attorneys for the defense have not contacted our attorney.
REMINDER: the developer claimed that our deed is irrelevant. Why press owners for a signature if he is so confident? If our deed of dedication has no value, why are individual offers being made for signatures?
City:
UPDATE: City Council approved two housing developments, Bixby Meadows (151st and Harvard) and South Yale Meadows (151st and Yale), and an industrial park on Kimberly Clark Road. Council increased the minimum square foot requirement from 1500 to 1600 sq ft for South Yale Meadows, allowing only 40% of the homes being built to be at the minimum requirement. They also removed hardy board as an option for masonry. Finally, they removed dispensary as an approved use for the commercially zoned area of the development at the SW corner of 151st and Yale. South Yale Meadows adds 351 homes. The previously approved neighborhood for Yale Heights, located on the SE corner of Yale and 151st, adds 200 homes and an apartment complex. Both corners of Yale are zoned commercial.
UPDATE: Additional concerns regarding platting and permitting have been raised to the city. We are in ongoing contact, and expect to receive their responses regarding these and the previously identified issues next week.
Other HOA Updates:
REMINDER: April 30th is the date of our Spring garage sale.
HOA Dues: Liens are being processed in the next three weeks for past due accounts. Unsure if you have a balance? Contact Dennis Peterson at treasurer@ccwhhoa.com or check your balance online at ccwhhoa.com.
HOA Website: Did you know you can pay your bill online via credit card or ACH? Other features include our covenants, a message board, and calendar. We look forward to your feedback. Please email info@ccwhhoa.com.
FACT: We received a tip that claims are being made that the HOA account is being bankrupted to support the lawsuit. This is absolutely not the case. We have a budget, which is well managed to cover the expenses of the HOA.
NOTICE: Soliciting is not allowed in our neighborhood. Report any violations to the City of Bixby Police Department.
QUESTION: Our social committee proposes a Spring picnic. What are your thoughts about having a picnic one weekend in May?
